The present general conditions of sale are concluded between, on the one hand, the SARL France Cyclisme - 604 rue Denis Papin - 73290 La Motte-Servolex - France - and, on the other hand, Internet users who wish to purchase an item presented on the "DECATHLON AG2R LA MONDIALE TEAM" site visible at the address: mfgjhyz.cluster024.hosting.ovh.net hereinafter referred to as "the Customer".
These conditions govern the sale of any product presented on the site "mfgjhyz.cluster024.hosting.ovh.net" by the company France Cyclisme. The parties agree that their relations will be exclusively governed by this contract, to the exclusion of any other condition. The items are offered for sale only to natural persons not traders.
1. ACCEPTANCE OF THE CONDITIONS
You declare that you have read and accepted the present general conditions of sale before placing your order.
2. PRICE
The prices of our products are indicated in euros all taxes included except participation in the expenses of treatment and forwarding.
The prices indicated take into account the VAT applicable to this day. If one or several rates were to be modified, in rise or in fall, during the season, this change will be reflected on the price of the articles.
The products remain the property of France Cyclisme until the complete collection of the price by France Cyclisme.
3. ORDER
To place an order, the Customer fills his basket and pays by credit card. He can also print the content of his basket and send it back with the payment to the following address France Cyclisme - Club des Supporters - 604 rue Denis Papin - 73290 La Motte-Servolex - France
France Cyclisme reserves the right to cancel any order from a customer with whom there is a dispute over payment of a previous order.
The information given by the buyer when placing the order is binding on the buyer: in the event of an error in the recipient's contact details, the seller cannot be held responsible for the impossibility of delivering the product.
4. AVAILABILITY
France cyclisme does not have vocation to sell in important quantities the proposed products. Consequently, France cyclisme reserves the right to refuse the orders of the same product in important quantity and this from 5 identical articles.
Our product offers and prices are valid as long as they are visible on the site, within the limits of available stocks. For products not stocked in our premises, our offers are valid subject to availability from our suppliers.
In this context, information on the availability of products is provided to you at the time of placing your order. This information coming directly from our suppliers, errors or modifications can exceptionally exist. In the event of unavailability of product after placing your order, we will inform you by mail or by post upon receipt of information received by the suppliers. Your order will be automatically cancelled and you will be immediately refunded.
In case of unavailability of all or part of the order, the refund will be made by check, at the latest within thirty days from the payment of the sums paid by the Customer.
5. DELIVERY
The delivery is carried out within 10 days as from the reception of the payment of the order and under 30 days for the DOM-TOM and the foreign countries, except any fortuitous occurence or force majeure which would delay the delivery independently of the will and the diligences of France Cyclisme.
Delivery will be made by La Poste. Possible delays do not give the buyer the right to claim damages.
For reasons of availability, an order can be delivered in several times to the customer. In this case, the customer only pays for one delivery. If the customer wishes 2 places of delivery, he places 2 orders, with the related delivery charges.
6. PAYMENT
The price of the products is payable by check or credit card. The Customer also has the possibility of making his payment by Money Order.
The reception of the order form accompanied by the payment will be worth irrevocable engagement between the parts.
In addition, France Cyclisme reserves the right to refuse any order from a customer with whom there is a dispute. France Cyclisme will process the order upon receipt of payment from the customer.
7. WITHDRAWAL AND REFUND
The period during which the customer may request an exchange or exercise his right of withdrawal is 14 days from the date of receipt of the item(s). When the 14-day period expires on a Saturday, Sunday or holiday, it is extended to the next working day.
The return of the item(s) within this period must be accompanied by a copy of the purchase invoice. Moreover, the item(s) must be returned in their original packaging and complete (packaging, accessories, labels...), to the following address France Cyclisme - Club des Supporters - 604 rue Denis Papin - 73290 La Motte-Servolex - France.
Items returned incomplete, damaged or soiled by the customer will not be accepted.
In case of exercise of the right of withdrawal, France Cyclisme is required to exchange or refund the sums paid by the customer, without charge, except for the cost of return. The refund is due within a maximum of 14 days following the date on which the right of withdrawal was exercised.
The refund will be carried out by the same means of payment as that used by the customer except agreement between this last and France Cyclisme.
To exercise the right of withdrawal, the customer must notify FRANCE CYCLISME of the decision to withdraw from this contract by means of an unambiguous statement (e.g. letter sent by post or e-mail). The customer can use the following model of withdrawal form but it is not obligatory.

8. GUARANTEE
The seller is liable for defects in the conformity of the goods to the contract under the conditions of Article L. 211-4 et seq. of the Consumer Code and for hidden defects in the thing sold under the conditions provided for in Articles 1641 et seq. of the Civil Code. (Article 2 of the order of December 18, 2014)
FRANCE CYCLISME reminds the consumer that within the framework of the legal guarantee of conformity :
- he has a period of 2 years from the delivery of the property to act;
- he can choose between repairing or replacing the goods, subject to the cost conditions provided for in Article L. 211-9 of the Consumer Code;
- he is exempted from proving the existence of the lack of conformity of the goods during the 6 months following the delivery of the goods. This period is extended to twenty-four months as of March 18, 2016, except for used goods;
- the legal guarantee of conformity applies independently of any commercial guarantee that may have been granted;
- the consumer can decide to implement the guarantee against the hidden defects of the sold thing within the meaning of the article 1641 of the civil code and that, in this hypothesis, he can choose between the resolution of the sale or a reduction of the selling price according to the article 1644 of the civil code.
9. DISPUTES
This contract is subject to French law.
France Cyclisme cannot be held responsible for damages of any kind, whether material or immaterial or physical, which could result from a malfunction or misuse of the marketed products. It is the same for the possible modifications of the products resulting from the manufacturers. The responsibility of France Cyclisme will be, in any case, limited to the amount of the order and could not be called into question for simple errors or omissions which could have remained in spite of all the precautions taken in the presentation of the products.
In case of difficulties in the application of the present contract, the purchaser has the possibility, before any legal action, to seek an amicable solution in particular with the assistance of: a professional association of the branch, an association of consumers or any other council of his choice.
It is reminded that as a general rule and subject to the appreciation of the Courts, the respect of the provisions of the present contract relating to the contractual guarantee supposes that the purchaser honors his financial commitments towards the seller.

10. INTELLECTUAL PROPERTY AND COMPETITION
All elements of the DECATHLON AG2R LA MONDIALE TEAM website, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents.
Any user who has a personal website and wishes to place, for personal use, on his site a simple link referring directly to the Homepage of the DECATHLON AG2R LA MONDIALE TEAM website, must request prior authorization from France Cyclisme. This does not constitute an implicit affiliation agreement. On the other hand, any hypertext link to the DECATHLON AG2R LA MONDIALE TEAM online store using framing, deep-linking, in-line linking or any other deep-linking technique is strictly prohibited. In all cases, any link, even if tacitly authorized, must be removed on request from France Cyclisme.
11. LEGAL INFORMATION
The personal information collected for the purposes of distance selling is mandatory, this information being essential for the processing and delivery of orders, as well as for the establishment of invoices. The lack of information leads to the non-validation of the order.
